Terms and Conditions of Use

Oripari ("we," "us," or "our") is operated by Probits Pty Ltd (ABN 79664029216), located at 15/43-47 Sheffield St, Merrylands NSW 2160, Australia. These Terms and Conditions (“Terms”) govern your use of the Oripari mobile application and related services (collectively, the “App”). By using, browsing, or ordering any services via the App, you accept these Terms and agree to comply with them fully.

1. Introduction

These Terms govern your use of the App, owned and operated by Probits Pty Ltd. We may update these Terms at our sole discretion by posting updated Terms within the App, effective immediately upon posting. Your continued use after changes signifies acceptance. If you do not agree, you must stop using the App. We reserve the right to suspend or withdraw access without notice, particularly for breaches or unlawful conduct. We do not guarantee uninterrupted availability or the accuracy, reliability, or completeness of content or third-party services linked through the App.

2. About Oripari

Oripari is a community platform primarily for immigrants in Australia, especially Nepalese immigrants, enabling users to post and discover job and room information. Additional services include:

  • Ordering gifts (e.g., cakes) for delivery to relatives in Nepal.
  • Subscription services for astrologers based in Nepal.
  • Access to Nepalese news, horoscopes, and calendar event information.

The App currently does not support integrated in-app payment processing; payments are handled externally with third-party providers. Future versions may include payment features.

3. Account Registration and Eligibility

To access full features, you must register an account with accurate, current, and complete information. You must be at least 18 years old and legally capable of forming binding contracts. Minors may not register or use the App without parental or guardian consent. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. Notify us immediately of any unauthorized use. Creating multiple accounts or using another’s account without authorization is prohibited.

4. Your Obligations as a Member

You agree to:

  • Use the App lawfully and in accordance with these Terms and applicable regulations.
  • Not share your account or login credentials.
  • Maintain accurate and up-to-date personal information.
  • Not impersonate others or use another user’s identity.
  • Not harass, stalk, threaten, or abuse other members.
  • Not use the App for illegal or unauthorized commercial purposes without our approval.
  • Not send unsolicited communications or collect others’ data without consent.
  • Not use automated means (bots, scrapers, etc.) to access or interfere with the App.
  • Not post false, misleading, defamatory, offensive, or unlawful content.
  • Comply with content guidelines or community standards published within the App.

5. User-Generated Content

You retain ownership of content you submit but grant Probits a worldwide, royalty-free, transferable, sublicensable, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content for the App’s operation and promotion. You warrant that your content does not violate laws or third-party rights. We may remove or restrict content that violates these Terms. You may revoke this license by providing written notice; we will cease using your content for promotional purposes within 14 days.

6. Services Between Providers and Receivers

The App facilitates interactions between service providers (“Providers”) and receivers (“Receivers”) for job postings, room listings, gift orders, and astrology subscriptions. Both must register accounts. Payments are made outside the App through Probits’s official payment accounts in AUD and NPR. Probits acts as a payment processor and intermediary, but contracts remain between Providers and Receivers. Providers must comply with Australian Consumer Law. Receivers must contact Providers for refunds or disputes; unresolved issues can be escalated to Probits after 14 days.

7. Intellectual Property

The App and its contents, including software, graphics, trademarks, and text, are owned or licensed by Probits and protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, revocable license for personal, non-commercial use. Unauthorized copying, modification, or reverse engineering is prohibited and may result in account termination and legal action.

8. Privacy and Data Protection

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your data. By using the App, you consent to these data practices. We take reasonable measures to protect your data but cannot guarantee absolute security.

9. Orders, Payments, and Refunds

Payments are processed externally via Probits’s official payment accounts in AUD and NPR. Probits manages payment processing, but service agreements are between Providers and Receivers. Providers set payment terms, which Receivers must review. Refund requests or disputes should be directed to Providers first; Probits may facilitate refunds if agreed. All pricing is in AUD unless specified.

10. Disclaimer and Limitation of Liability

The App is provided “as is” without warranties. We do not guarantee the accuracy, reliability, or availability of content or third-party services. To the fullest extent permitted by law, Probits disclaims liability for damages from App use. You use the App at your own risk. Nothing in these Terms limits your statutory rights.

11. Indemnity

You agree to indemnify Probits, its affiliates, officers, employees, and agents from claims, damages, or expenses arising from your breach of these Terms, misuse of the App, or infringement of third-party rights.

12. Account Termination and Suspension

You may delete your account via App settings, with 30 days to reverse deletion. We may suspend or terminate your account without notice for violations or illegal conduct. Termination does not waive accrued rights or liabilities.

13. Complaints and Dispute Resolution

We aim to acknowledge complaints within 5 business days and resolve them within 21 days. Contact us at:

14. General

These Terms constitute the entire agreement between you and Probits. You may not assign your rights; we may assign without consent. We are not liable for failures due to causes beyond our control. Failure to enforce provisions is not a waiver. Notices must be in writing. These Terms benefit Probits and its affiliates. Invalid provisions are severed without affecting the remainder. These Terms are governed by the laws of New South Wales, Australia, with exclusive jurisdiction to its courts.

15. Definitions and Interpretation

“You” and “User” mean any person using the App. “Probits,” “we,” “us,” “our” mean Probits Pty Ltd. “Provider” means a user providing services or products. “Receiver” means a user receiving services or products. Words importing singular include the plural and vice versa.
